UAE Overstay Fine Waiver: Who Qualifies and How to Apply?
There is no active blanket overstay amnesty in the UAE right now, the 2026 airspace-disruption waiver ended on 31 March 2026. You can still apply for a discretionary waiver if your overstay was caused by genuinely exceptional circumstances, such as a medical emergency or being stranded, by submitting a justification letter and supporting documents to ICP or GDRFA.
- Check for any current amnesty on official ICP or GDRFA channels.
- Gather proof of your exceptional circumstances.
- Submit a justification letter to ICP or GDRFA.
Is there an active overstay waiver right now?
This is worth being clear about, because a lot of older articles still say otherwise. In early 2026, the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) granted a temporary waiver for overstay fines incurred on or after 28 February 2026 by people who could not leave because of regional airspace disruptions and suspended flights. That measure applied automatically in the system, but it expired at the end of 31 March 2026.
So as things stand, there is no general overstay amnesty in effect. The UAE does run periodic amnesty campaigns from time to time, and they are announced officially through ICP and GDRFA, so it is worth checking their channels before you pay. Outside of those windows, relief is handled case by case.
Who can get an overstay fine waived?
A discretionary waiver is not granted simply for asking. It is meant for situations where the overstay was genuinely outside your control, and your application is only as strong as the evidence behind it. These are the circumstances most likely to be considered.
| Circumstance that may qualify | Evidence to include |
|---|---|
| Stranded by flight or airspace disruption | Flight cancellation or rescheduling documents |
| Medical emergency or hospitalisation | Hospital reports and medical certificates |
| Documented financial hardship | Proof of your financial situation |
| An error outside your control | Evidence the overstay was not your fault |
Simply not having paid, or not realising the visa had expired, is not on its own a reason a waiver will be granted. The stronger and better-documented your circumstance, the better your chances.
How to apply for a discretionary waiver?
You apply to the authority that handles your visa, GDRFA for Dubai visas, ICP for the other emirates. Put together a clear application rather than a bare request:
- Write a formal justification letter explaining what happened and why you could not leave or renew in time.
- Attach a copy of your passport and your expired visa.
- Include your supporting evidence, medical reports, flight cancellations, or other proof of your circumstances.
- Submit it to ICP or GDRFA through their channels, or in person at an Amer or immigration service centre, and keep a copy of everything.
Before you apply, it helps to know the exact amount in question, so run a check of your overstay fine first. The rules behind the fine, including the grace periods, are set out in our UAE overstay fine 2026 guide.
What to do if you cannot get a waiver?
If your circumstances do not qualify, the practical options are to pay the fine or to arrange your departure. Bear in mind the fine does not freeze while you decide, it keeps accruing at AED 50 a day until it is paid or you leave, so waiting usually makes it worse. Pay through the ICP or GDRFA portal, the UAE Pass app, or in person.
If you have overstayed for a long time and your visa situation is tangled, you may need an exit permit to leave the country lawfully. The full set of visa options is in our UAE visa and immigration guide.
Frequently asked questions
Is there a UAE overstay fine waiver in 2026?
There is no active general amnesty at the moment. The 2026 waiver applied only to fines incurred on or after 28 February 2026 by people stranded by airspace disruptions, and it expired on 31 March 2026. You can still apply for a discretionary, case-by-case waiver if your overstay was caused by genuinely exceptional circumstances.
Who qualifies for an overstay fine waiver?
Waivers are considered where the overstay was outside your control, for example being stranded by flight disruptions, a medical emergency, documented hardship, or an administrative error. The application must be backed by evidence such as flight cancellations or hospital reports. Not realising a visa had expired is not, by itself, a qualifying reason.
How do I apply for an overstay fine waiver?
Submit a formal justification letter, a copy of your passport and expired visa, and supporting documents to ICP, or to GDRFA for a Dubai visa. You can apply through their channels or in person at an Amer or immigration centre. Keep copies of everything, and check your fine amount beforehand so your application is accurate.
Does the fine keep growing while I apply for a waiver?
Yes. Unless a formal waiver or amnesty applies, the overstay fine continues to accrue at AED 50 a day while your application is considered. That is why it is best to act quickly, gather strong evidence, and, if a waiver is unlikely, consider paying or arranging departure rather than letting the amount build up.
